Undeclared foreign accounts: the problem stopped being a tax one years ago

Written for Mexico. This analysis applies to Mexican federal tax law — ISR (income tax), IVA (VAT) and SAT rules — and cites Mexican statutes. Amounts are in Mexican pesos (MXN).

Quick answerCRS and FATCA report your foreign accounts to Mexico automatically. When investing abroad is perfectly legal and when it becomes tax fraud (arts. 108-109 CFF).

Let's start with what is legal, because it gets lost in the noise: investing abroad is perfectly lawful. A Mexican resident can open accounts in the United States, Spain or Switzerland, buy ETFs, bonds or real estate — as long as the money has a provable origin and the yields are declared in Mexico. The problem is not the account: it is the silence.

The era of bank secrecy is over (and no one told the optimists)

Two automatic information-exchange frameworks operate across practically the entire global financial system: FATCA (the U.S. regime) and CRS (the OECD common standard, signed by more than a hundred jurisdictions, Mexico included). Translated into practice: when you open an account abroad, the institution identifies your tax residence and reports balances, interest and dividends to the authorities of your country — every year, without anyone requesting it. The SAT (Mexico's tax administration) does not have to find you: you show up in a file.

Where the criminal line sits

Omitting foreign income from your return is a tax omission; doing so through concealment — accounts in third parties' names, money "banked" abroad without declaring its origin, structures whose only function is to hide — falls within tax fraud (arts. 108 and 109 of the CFF, the federal tax code), a crime carrying a prison sentence that scales with the amount and is aggravated by conduct such as the use of false documents. The lethal combination is the classic one: income not declared in Mexico + a transfer abroad + omission of the report = a detectable tax discrepancy, with the criminal route open.

Do you have accounts abroad and doubts about your situation? That is exactly the moment to act

Voluntary regularization — before the authority issues a demand — radically changes the picture: the omitted taxes are paid with their accessory charges, and the criminal exposure for those facts is closed. Strategium evaluates your case with numbers and lays out the routes: from a simple correction to a complete international restructuring. Absolute confidentiality, like everything we do.

What international wealth done right looks like

Clear labels: investing abroad with clean origin and everything declared — safe. International structures with substance, reported, for wealth purposes — defensible when well executed. Hidden accounts, front men or "banking" abroad what you did not declare at home — criminal red zone, and with automatic exchange, a red zone with an expiration date to boot.

Frequently asked questions

I inherited money that sits in a U.S. account — do I have a problem?

Inheritances are exempt from ISR for the heir, but they must be reported (for information purposes) when they exceed certain amounts, and the subsequent yields are indeed taxable. With the estate documentation, your case can be put in good order — the mistake would be letting the account sit in silence for years.

How much does it cost to regularize undeclared accounts?

The ISR omitted for the open years (up to 5 years), with inflation adjustment and surcharges. It hurts, but it is a finite, calculable number — versus a criminal exposure that does not expire the same way and grows with every year of silence. The first step is to quantify it; with the number on the table, the decision is usually obvious.

Does the SAT really use the CRS information?

Yes — the data feeds invitation letters and audit programs for foreign income and has done so for years. The right question is not whether they use it, but where you stand in the line.
